Terms of Use

These Terms of Use ("Terms") govern your use of the free property tools, calculators, lookups, report cards, and reports (together, the "Tools") provided by The Gioia Group at Nationwide Realty International, LLC ("we," "us," "our"). By using the Tools, requesting or downloading any report, or submitting your contact information, you agree to these Terms. If you do not agree, do not use the Tools.

1. Educational purpose only — no advice, no reliance

The Tools are provided free of charge, for general educational and informational purposes only. They do not constitute, and must not be relied upon as, tax, legal, financial, investment, real estate, brokerage, appraisal, surveying, inspection, engineering, structural, construction, or insurance advice, or professional advice of any other kind.

Nothing produced by the Tools — including any report, report card, score, flag, estimate, or figure — is a recommendation, an opinion of value, an appraisal, an inspection, a survey, a title search, a flood determination, an insurance quote, or a legal conclusion. You agree that you will not rely on the Tools as the basis for any decision regarding the purchase, sale, financing, investment in, leasing, ownership, condition, safety, maintenance, or repair of any real property, condominium unit, building, or association interest, or for any decision to purchase or decline insurance, to relocate, or to change your state of domicile.

2. No professional relationship is created

Using the Tools, requesting or receiving a report, or submitting your contact information does not create a brokerage, agency, fiduciary, transaction-broker, employment, or attorney-client relationship of any kind between you and us. It does not make you our client or customer, and it obligates you to nothing. No such relationship arises unless and until it is set out in a separate written agreement signed by both you and us. We owe you no fiduciary duty by reason of your use of the Tools.

We are a licensed Florida real estate brokerage. If you later choose to engage us as your real estate professional, that engagement — and any duties it carries under Chapter 475, Florida Statutes — will be governed by a separate written agreement, not by these Terms.

3. Public records, estimates, and accuracy

The Tools draw on public records, including records of the Florida Department of Business and Professional Regulation, county property appraisers, and FEMA. Those records are compiled and maintained by third parties. They are periodically updated and may contain discrepancies, omissions, or inaccurate, incomplete, outdated, or false information. The absence of a filing is not proof that an inspection or study was not performed.

All figures the Tools produce are estimates and illustrations, not quotes, appraisals, bids, or determinations. Actual taxes, insurance premiums, assessments, costs, and outcomes may differ materially. Address matches may correspond to an individual unit folio rather than to a building as a whole. Public records change; you must independently re-verify every material fact before you act on it.

The Tools do not inspect any property and cannot detect actual structural defects, hazards, reserve shortfalls, special assessments, litigation, insurance status, code violations, or other conditions.

4. No warranty

The Tools are provided "as is" and "as available," without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, completeness, timeliness, or non-infringement. We do not warrant that the Tools will be available, uninterrupted, error-free, or current. We may change, suspend, or discontinue the Tools at any time without notice.

We are not affiliated with, sponsored by, or endorsed by any property appraiser, tax collector, the Florida Department of Business and Professional Regulation, FEMA, or any other government agency.

5. Assumption of risk, release, and hold harmless

You use the Tools entirely at your own risk, and any decision you make is your own. To the fullest extent permitted by law, you agree that The Gioia Group, Nationwide Realty International, LLC, and their respective members, officers, directors, agents, employees, brokers, associates, workers, contractors, licensors, and affiliates (together, the "Released Parties") shall not be liable for any loss, damage, cost, expense, or claim of any kind — direct, indirect, incidental, special, consequential, exemplary, or punitive, including lost profits, lost opportunity, diminution in value, repair or assessment costs, or lost data — arising from or related to your use of, or reliance on, the Tools or any information they provide, including any discrepancies, omissions, or inaccurate or outdated information.

You release the Released Parties from, and agree to hold each of them harmless against, any and all such claims. Information obtained from the Tools must not be used against the Released Parties in any proceeding. To the fullest extent permitted by law, the total aggregate liability of the Released Parties arising out of or relating to the Tools shall not exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

You agree to indemnify and hold the Released Parties harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) brought by a third party and arising out of your use of the Tools, your breach of these Terms, or your violation of any law or the rights of any third party.

6. Always consult a licensed professional first

Before you buy, sell, invest in, lease, or hold any real property — or take any action based on anything the Tools show you — always consult a licensed attorney and a licensed real estate professional, together with a qualified tax professional, certified public accountant, licensed insurance agent, licensed inspector, or licensed engineer, as appropriate to your circumstances. Verify every material fact with the source: the condominium association, the county, the carrier, or the professional. Only a licensed professional reviewing your specific situation can advise you.

7. Your information and how we use it

If you submit your name, email address, telephone number, or a message through the Tools, you are asking us to contact you. You consent to being contacted by The Gioia Group by email or telephone about your real estate search and about the report you requested. We use your information to prepare and send the report you asked for, to respond to you, and to offer our real estate services.

We do not sell your personal information. We share it only with service providers who help us operate the Tools and deliver your report (for example, our hosting and email providers), and where required by law. You may ask us to delete your information, or ask us to stop contacting you, at any time by replying to any message from us. Requests submitted through the Tools are logged, including the date and time you agreed to these Terms.

8. Acceptable use

You may use the Tools for your own personal, non-commercial purposes. You may not scrape, bulk-download, resell, republish, or redistribute the Tools or their output; use them to build a competing product or database; misrepresent their output as an inspection, appraisal, or professional opinion; or use them for any unlawful purpose.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of or relating to the Tools or these Terms shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.

10. Changes to these Terms

We may update these Terms at any time. The version and date at the top of this page identify the current Terms. Your continued use of the Tools after a change takes effect constitutes acceptance of the updated Terms. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
